190 & 491 – Residence Requirements

 

Residence Requirements

Australian Capital Territory

  • If you are currently residing in an Australian state other than ACT, you are ineligible to complete a ‘Canberra Matrix’ and thus apply for ACT nomination.
  • For 491 nomination, you must be residing in Canberra for at least 3 months immediately before the date of Matrix submission. You are not eligible for the nomination if you, your spouse/ partner or children are living or working in another Australian state or territory.
  • For 190 nomination, you must be residing in Canberra for at least 6 months immediately before the date of Matrix submission.
  • If you are currently residing offshore, you must have been a resident overseas for at least 12 months, and you, your spouse/ partner or children must not be living or have lived in another Australian state or territory within the last 12 months.

South Australia

  • If you are currently residing in an Australian state other than SA, you are ineligible to apply for SA nomination.
  • If you are currently residing offshore, and have previously studied or worked in another Australia state in the last 10 years, you are only eligible to apply for 491 nominations.
  • If you are currently residing in SA, and have lived, studied or worked in another Australian state before moving to South Australia, you must be currently working for the last 6 months (minimum 20 hours per week) in a skilled occupation in South Australia. No distinction exists whether the nomination relates to 190 or 491.

Tasmania

  • Your application will be considered with high regard if you are currently residing in an area outside of Greater Hobart and have skills in the following areas:
    • Health
    • Trades and construction
    • Engineering
    • Community services (including aged and disability care)
  • There are 3 different categories for the TAS nomination.
    • Category 1 – Tasmanian Graduate: You must have lived in Tasmania for at least 2 years and continue to be living in Tasmania.
    • Category 2 – Working in Tasmania: You must have been living and working in Tasmania for 6 months working a minimum of 35 hours per week in one full time or two part-time jobs for employers who have been actively operating in Tasmania for the past 12 months.
    • Category 3 – Overseas applicant: A highly limited number of applications are considered and accepted.

New South Wales

  • If you are currently residing in an Australian state other than NSW, you are ineligible to apply for NSW nomination.
  • If you are currently residing offshore, you would need to provide evidence of a genuine job offer where you would be in the nominated occupation for permanent (not casual) work, for at least 35 hours per week for a minimum period of 12 months.
  • If you are applying for 491 nomination, the employment must be in regional NSW.

Northern Territory

  • If you are currently residing in Australia, you would be eligible for 491 nomination if you have lived and worked in NT for at least 6 months and 190 nomination if you have lived and worked in NT for 2 years.
  • If you are currently residing offshore and have been employed in the nominated occupation for at least 12 months out of the last 24 months prior to the nomination application, you may be eligible but only for 491 nomination. Furthermore, applicants must have an offer of relevant employment on a full time basis in the NT, if the NT Migration Occupation List requires it.

Queensland

  • If you are currently residing in an Australian state other than QLD, you are ineligible to apply for QLD nomination.
  • For 491 nomination, you must be living and working full time with minimum of 35 hours per week in your nominated occupation in regional QLD for at least 3 months.
  • For 190 nomination, you must be living and working full time with minimum of 35 hours per week in your nominated occupation in QLD for at least 6 months.
  • If you are residing in an overseas country, you must have a job offer for a minimum duration of 12 months with a Queensland employer registered in Australia.

Victoria

  • If you are currently residing in an Australian state other than VIC, you would need to provide evidence of a genuine Victorian job offer where you would be in the nominated occupation for permanent (not casual) work, for at least 20 hours per week, and for at least 6 continuous months.
  • For 491 nomination, your job offered must be located in regional VIC.

Western Australia

  • WA does not have explicit residence requirements.
